Can a Professional Building Manager File a Lawsuit Without an Assembly Resolution?

A recent Serbian Supreme Court judgment clarifies whether professional building managers may initiate court proceedings on behalf of homeowners’ associations without prior approval of the assembly. The decision confirms that, in principle, an assembly resolution is required, which may have significant implications for debt collection, enforcement actions and the day-to-day management of residential buildings.
