The Pastiche Exception in Copyright Law: What Recent Cases Mean for Creators and for AI

The CJEU's Pelham II ruling defines and sets the boundaries for the defence of pastiche. Whilst the court's ruling is not binding on the UK courts they may take it into account. The court's decision also has implications in the context of AI outputs that are 'in the style' of a copyright work.
