Shein v Temu: High Court Declines to Find Platform Liability for Copyright Infringement

The High Court has dismissed Shein's copyright claims against Temu, relating to product listing photographs. The Court found that Temu had not committed any acts of copyright infringement but, even if it had, its role in hosting merchant-uploaded photos was "technical, automatic and passive," entitling it to rely upon the hosting defence.
