The Court of Appeal has overturned the High Court in RTM v Bonne Terre, confirming that consent under UK GDPR and the Privacy and Electronic Communications Regulations is an objective test. The ruling removes the "ineradicable" risk that businesses, particularly in the betting and gaming sector, faced under the High Court's judgment.
