Serbia’s Labour Law requires employers to respect employees’ right to defence in disciplinary proceedings that may lead to dismissal. Although the Law does not formally regulate investigative procedures, employers must collect evidence lawfully and provide employees with a written warning specifying the grounds for dismissal, relevant facts, and evidence. Employees must be given at least eight days to respond, and employers must consider their defence before making a final decision. Failure to respect these procedural safeguards may result in unlawful termination of employment.
