Binder Grösswang (Austrian legal counsel), together with Asters (Ukrainian legal counsel), successfully represented Oschadbank before the Vienna Commercial Court in proceedings concerning the protection of the bank’s business reputation against Boryslav Bereza. The case was initiated at the defendant’s place of residence.
On 12 May 2026, the court granted Oschadbank’s application for interim measures. The court ordered the defendant to refrain from disseminating, including on social media, statements containing allegations against the bank and its officers in the context of the “Hungarian case,” and to remove previously published posts containing such statements. The preliminary injunction has been duly served on Mr Bereza and is binding upon him.
A preliminary injunction serves as an effective mechanism for the prompt protection of a claimant’s rights and for preventing further dissemination of false or misleading information. In accordance with the EU Digital Services Act, Facebook and Telegram platforms have been notified of the decision.
